Terms of service

1. General provisions

Please read these terms and conditions carefully before purchasing products on the website www.padelspirit.ch. By purchasing products on this site, you automatically accept these terms and conditions.

Please note that if you have purchased products on promotion, different terms and conditions of sale may apply, which are referred to separately as part of the promotion concerned.

2. Ordering procedure and formation of this contract

2.1. We deliver orders within Switzerland. The ordering procedure through our online shop involves the following steps:

• First, select the goods you want.

• You will then need to provide your customer details, including the billing address and the delivery address (if different).

• The next step is to select the payment method.

• Finally, you have the opportunity to check all the information provided (e.g. name, contact details, address, payment method, goods ordered) and to correct it where necessary, before sending us your order by clicking “Buy now” and confirming these terms and conditions.

2.2. All the information on the website is an invitation to treat only. In other words, the information does not constitute an offer or a binding contract. By placing your order, you make a binding offer to us to enter into a contract of sale with you. All orders you place are subject to our acceptance. The automatic order confirmation that follows acknowledges that we have received your order but does not yet constitute acceptance of it. Your order is accepted by means of a separate dispatch confirmation email or by delivery of the products ordered. A binding contract of sale is concluded as soon as you receive the dispatch confirmation email or the shipment. With the dispatch confirmation we will send you full details of the order together with information on payment and customer service. Please note that partial deliveries are also possible. In that case, the contract of sale applies only to the products confirmed in the dispatch confirmation. You will be informed in a separate message of the subsequent delivery of the missing products.

2.3. You must ensure that all the information you have provided in your enquiry or your order is correct and complete. We are entitled to check an order in advance at any time and/or to refuse to accept an order without giving reasons and without liability to you or to third parties. If we do not confirm acceptance of your order within ten working days, it is deemed to have been refused. We may choose not to accept your order at our own discretion. Should we not accept your order (or part of it), we are entitled to cancel your order (or part of it) without incurring any liability to you or to a third party. Following cancellation, we will of course refund the amount you have paid us for the cancelled order or the cancelled part of it.

2.4. We do not file an accessible copy of this contract of sale. We therefore encourage you to download, save and/or print a copy of the dispatch confirmation and of these terms and conditions for your records.

2.5. If, for any reason, we discover after the contract has been concluded that we can no longer deliver the products ordered owing to unforeseen circumstances, we are entitled to terminate the contract. We will inform you immediately by email and refund any payments made.

2.6. Please understand that goods can only be sold and delivered in the limited quantities offered.

3. My account

3.1. You may also place an order with us without creating your own user account (“guest user”), provided you supply all the required details during the ordering procedure. You also have the option of creating your own user account protected by a password (“registered user”). This saves your details, so you will not have to enter them again when you place a further order. You also gain access to the “My account” section, which gives a complete overview of your profile, orders in transit, previous orders and shipping and payment details.

3.2. If you create and use an account on our website, you are responsible for protecting it and your password, and for restricting access to your computer. Furthermore, to the extent permitted by applicable law, you agree to accept responsibility for all activities carried out through your account and/or your password. You are required to take the necessary measures to keep your password confidential and secure, and you undertake to inform us immediately if you have reason to believe that a third party has obtained access to your password or used it without your prior authorisation, or that such unauthorised use is likely.

4. Tracking your order

You can track your order using the order number shown in the dispatch confirmation email from our service provider that we sent you. This takes you to our delivery service's site, where you will find up-to-date information on your order and its delivery.

5. Prices, delivery charges

5.1. All prices are inclusive of tax, including sales taxes and duties, where these are not shown separately. Obvious errors excepted.

5.2. The applicable delivery charges are calculated by Padelspirit for each delivery address. For further details, please see our shipping policy. The delivery charges payable by you will be shown separately before your order is confirmed. The method of calculation, the price details of your products and the final price will be shown to you before you confirm your order. Total delivery charges are calculated automatically and displayed to you before your order is completed.

5.3. For deliveries from the European Union to Switzerland, import and export charges, together with any customs duties and levies, are already included in the sale price, so that you are not faced with any surprises.

5.4. Every effort is made to ensure that the information on our website is correct; nevertheless, an error may exceptionally be found in the product presentation, the description of the specifications or the price list. If a pricing error is identified in your order, we are under no obligation to accept or fulfil an order for an item whose displayed information was incorrect, and we reserve the right to cancel that order, whether it has been confirmed or dispatched. In that case, you will be informed by email or by telephone of the full or partial cancellation of your order as soon as possible. If payment has already been made for those goods, the full amount debited will be refunded to you as quickly as possible. If the cancellation occurs after the items have been dispatched, the refund will be made once we receive the goods you have returned to us.

6. Delivery conditions

6.1. You will find on our website all the information concerning the availability of the products sold on padelspirit.ch (on the relevant product description page or in our shipping policy, for example). If you have ordered products with different delivery times, we reserve the right to send the products in a single shipment. In that case, the delivery time is determined by the item you have ordered with the longest delivery time.

Please note that all information regarding the availability of a product consists of estimates and approximate values only. Should Padelspirit discover, while processing your order, that the products ordered are no longer available, you will be informed by a separate email. Your rights are not affected.

6.2. If delivery to your address is impossible because the goods will not fit through your entrance, door or stairwell, or because you are not present at the specified delivery address even though you were given sufficient advance notice of the date and time of delivery, the costs generated by the attempted delivery are payable by you.

7. Transfer of risk

In the case of contracts under which we deliver the goods to you, the risk of loss of or damage to the goods passes to you when you, or a third party nominated by you other than the carrier, take physical possession of those goods. However, the risk passes to you when the goods are handed over to the carrier if it was you who instructed the carrier to transport the goods and that choice was not offered by us, without prejudice to your rights against the carrier.

8. Payment terms

8.1. Payment options

8.1.1. Credit cards

We accept the following credit cards: Visa Card, Master Card, Maestro.

To pay by credit card, you must choose a card type and enter your name, your credit card number, its expiry date and the last three digits shown on the back of the card. The order will be dispatched once your payment has been received by our accounts department, in accordance with the usual delivery times set out in these terms and conditions.

You confirm that the credit card used is your own and that all the details you provide to us in this respect, including but not limited to name and address, are complete, correct and accurate. You also confirm that the credit card is valid and that the payment details entered are correct. We are not responsible for charges or other amounts that may be applied by your card issuer or your bank as a result of processing your credit card payment in accordance with your order.

8.1.2. PayPal

PayPal is an online payment service that lets you pay securely, easily, quickly and free of charge. If you have decided to use PayPal, we will redirect you directly to the PayPal website once your order has been submitted. There you can log in with your PayPal access details or create a new account (registration and further information at www.paypal.com).

8.1.3. Other payment methods

You will see the various payment options available for your purchase before you place your order (in the footer, on the relevant product page and/or on the payment page, for example). The payment options available for your purchase may depend on the country selected (automatically or manually) at the time of your purchase, on your delivery address and, in some cases, on the products you have selected. We reserve the right to add or remove payment methods from time to time at our discretion.

8.2. If the amount due for the order cannot be collected, for whatever reason, your order will be cancelled.

9. Retention of title

The products delivered remain our property until you have paid in full all the amounts owed to us under any contract, including payment of charges, even in the case of earlier or later deliveries or of partial deliveries. You may not sell, dispose of or encumber the products before title to them has passed to you.

10. Returns and information on the right of withdrawal

10.1. You have the right to terminate the contract, without giving reasons, within 30 days of the day on which you, or a third party nominated by you who is not the carrier, took possession of the goods.

10.2. To exercise your right of withdrawal, you must inform us (Padelspirit, for the attention of “Customer Service”, Ch. Ouche-Dessus 16, 1616 Attalens, Switzerland, or by email to info@padelspirit.ch) in good time of your intention to withdraw from this contract.

10.3. In the event of withdrawal from the contract, the products must be returned no later than thirty (30) days from the day on which they were received. The deadline is deemed to have been met if you dispatch the products before the end of the thirty (30) day period.

If you wish to return a product purchased as part of a “buy one, get one free” promotion, please note the following: if you return the product you paid for, you must return the free product at the same time. Otherwise, we will claim payment of the corresponding amount or deduct it from the sum to be refunded.

10.4. If you change your mind, the cost of returning the item is yours to bear. Please note that if you do not follow the returns procedure set out in our refund policy, all costs relating to a non-compliant return (including but not limited to shipping charges and any customs duties) will also be payable by you.

10.5. You are answerable for the handling of the goods and will be held liable for any damage you cause. We expressly reserve the right to claim compensation for goods returned to us in a used or damaged condition. You are liable for any diminution in the value of the goods resulting from causes other than checking their condition, characteristics and functioning. We expressly reserve the right to deduct such compensation or diminution in value from the amounts to be refunded (set-off).

10.6. In the event of withdrawal from the contract, we will refund all payments relating to the purchased products you have returned (including ordinary delivery charges, where applicable, but excluding the higher delivery charges resulting from your choice of a special form of delivery). This refund will be made immediately or, subject to the situations mentioned below, no later than fourteen (14) days from the day on which we receive your notice of withdrawal. For this refund we will use the same means of payment you used for the original transaction, unless we expressly agree another means with you. Under no circumstances will we charge you a fee for this refund. We have the right to withhold a refund until you have returned the products to us or until you have supplied proof that you have returned the products, whichever is the earlier.

10.7. Padelspirit.ch does not offer the possibility of exchanging ordered products directly. If you do not wish to keep your goods, please return them in accordance with the information provided on returns and place a new order to receive the selected product in a different size or colour, for example.

10.8. Exclusion of the right of withdrawal

The right of withdrawal does not apply to contracts for:

• the supply of goods made to the consumer's specifications or clearly personalised;

• the supply of sealed goods which are not suitable for return for health protection or hygiene reasons and which were unsealed by the consumer after delivery;

• the supply of sealed audio or video recordings or sealed computer software which were unsealed after delivery.

• accessories and balls

12. Warranty and liability

12.1. When placing an order on this site, please take note of the general and product-specific information relating to the product ordered (in particular the characteristics, selection, maintenance, use and safety of the products) displayed on our site, together with the instructions contained in our user manuals.

12.2 Our liability applies expressly to the obligations and responsibilities described in this document, in so far as the law does not provide otherwise.

12.3 The warranty follows the statutory provisions and applies to complaints arising during the statutory warranty period. The warranty applies only to defects appearing during the warranty period. The length of the warranty period depends on the law applicable to the customer and starts when the goods are made available.

12.4 The warranty does not cover:

  1. Defects resulting from normal wear and tear of the product

  2. Defects caused intentionally

  3. Defects caused by improper transport or improper storage by the customer or the logistics company

  4. Defects or damage caused by improper use or misuse, or by insufficient or improper maintenance or care

  5. Defects caused by failure to follow the user manual

  6. Defects caused by assembly carried out by unqualified personnel or by incorrect adjustment

  7. Defects caused by modifications made to the product by the purchaser

  8. Defects caused by sharp objects, twisting, crushing, dropping, abnormal pressure or any other act.

12.5 Under no circumstances will we, or our representatives, be liable for incidental or consequential damage, whether the claim is based on contract, warranty, negligence or product liability, including but not limited to loss of property other than the product itself, loss of use of any property or other economic loss. Neither we nor any distributor will be subject to contribution or indemnity claims, whatever the cause.

13. Subcontracting and assignment

We reserve the right to subcontract, transfer, assign or novate all or part of our rights and obligations under these terms and conditions, provided that your mandatory rights are not affected. You may not subcontract, assign or otherwise transfer any of your rights or obligations under these terms and conditions without our written consent.

14. Governing law / place of jurisdiction

Save where the law requires otherwise, these terms and conditions of sale are governed by the law of the country to which we deliver under point 2.1, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG) and excluding conflict-of-law rules.
