1. General provisions

This data protection policy has been drawn up in accordance with the Swiss Federal Act on Data Protection (FADP) of 25 September 2020, which entered into force on 1 September 2023, and with its implementing ordinance (Data Protection Ordinance, DPO).

Where and to the extent that Regulation (EU) 2016/679 on data protection (GDPR) applies, in particular where the personal data of persons located in the European Union is processed, its provisions are also complied with.

The purpose of these legal frameworks is to protect the personality, fundamental rights and privacy of natural persons by ensuring that personal data is processed lawfully, fairly, transparently and proportionately, and that it is kept secure and confidential.

1.1. What is personal data?

Personal data means information about data subjects whose identity is established or can at least be established. Personal data includes, for example, name, address, telephone number, email address, user ID, credit card number, social media account ID, username, IP address and the like.

1.2. What data do we collect from you, and how and for what purposes do we process your data?

We collect user data from you (among other things, the details you provide when registering, placing an order, using our Padelspirit app, subscribing to newsletters or contacting us) and technical data (log files containing, for example, the IP address, date and time), provided that this is permitted by law or required in order to perform the contract or to safeguard our legitimate interests, or where you have given your consent to this.

1.3. Data of persons under 16 / sensitive data

Unless the consent of a parent or legal guardian has been obtained, Padelspirit does not wish to collect information from persons under the age of 16. However, as it is not always possible for us to determine the precise age of users, we cannot rule out the possibility that our offers and services occasionally contain personal data of persons under 16 without the consent of their parents or legal guardians. If we establish that persons below the required legal age have registered on our website or used our services without the consent of their parents or legal guardians, we reserve the right to exclude those persons from the offers and services concerned, to block them or to delete their data.

Furthermore, we do not wish to collect sensitive data such as your religious beliefs, health data or other special categories of personal data referred to in Article 9 GDPR, unless you have been expressly asked to provide such data.

2. PROCESSING OF PERSONAL DATA FOR INFORMATION PURPOSES ON THE WEBSITE

If you use our website purely for information purposes, that is to say if you do not register or transmit information to us in any other way, we collect only the personal data that your browser automatically transmits to our server. If you wish to view our website, we collect the following data, which is technically necessary for us in order to display our website to you and to ensure its stability and security (in addition to the data you provide on an optional basis depending on your cookie settings – see section 2.1).

the IP address

the date and time of the request

the time zone difference from Greenwich Mean Time (GMT)

the content of the request (the specific web page)

the access status / HTTP status code

the volume of data transferred in each case

the website from which the request is received

the browser

the operating system and its interface

the language and version of the browser software

2.1. Cookies

Like most websites, we use cookies, provided that this is technically necessary for the use of the website (Article 5(3) of the Privacy and Electronic Communications Directive, hereinafter the “e-Privacy Directive”) or that you have given your consent to this, which you may withdraw at any time. For further information, please see our cookie policy.

If you have any questions or comments on this subject, please contact us using the contact details given in section 9.

2.2. Google services

All the services referred to in section 2.2 are provided by Google Ireland, Gordon House, Barrow Street, Dublin 4, Ireland, and/or Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA (hereinafter “Google”).

You can prevent your participation in various Google services in several ways: a) by configuring your browser software accordingly – suppressing third-party cookies in particular means that you will not receive any third-party advertising; b) by deactivating the cookies used for conversion tracking, setting your browser to block cookies from the domain “www.googleadservices.com”, https://adssettings.google.com, bearing in mind that this setting will be cleared if you delete your cookies; c) by deactivating interest-based advertising from providers taking part in the “About Ads” self-regulation campaign via the link https://www.aboutads.info/choices, bearing in mind that this setting will be cleared if you delete your cookies; d) by deactivating them permanently in your Firefox, Internet Explorer or Google Chrome browser via the link https://www.google.com/settings/ads/plugin; e) by configuring your cookie preferences accordingly. In that case, please note that you may not be able to make full use of all the features of this offering.

For detailed information on how Google secures and processes your personal data, please see https://policies.google.com/technologies/product-privacy and https://policies.google.com/privacy.

Please also visit the Network Advertising Initiative (NAI) website at https://www.networkadvertising.org/ to find out more about responsible data collection and its use for digital advertising.

2.2.1. Google Analytics

This website uses Google Analytics, a web analytics service that employs “cookies”: these are text files stored on your computer that make it possible to analyse your use of the website. The information generated by the cookie about your use of this website is generally transmitted to a Google server in the USA, where it is stored.

Google will use this information on our behalf to evaluate your use of the website, compile reports on website activity and provide us with further services relating to website use and internet use. Google may also pass this information on to third parties where required by law or where such third parties process this data on Google's behalf. The IP address supplied by Google Analytics within the framework of Google Analytics will not be combined with any other Google data.

You can prevent cookies from being stored by configuring your browser software accordingly or by changing your configuration in our cookie management tool; please note, however, that in that case you may not be able to make full use of all the functions of this website. You can also prevent Google from collecting and processing the data generated by the cookie and relating to your use of our website (including your IP address) by downloading and installing the browser plug-in available at the following link: https://tools.google.com/dlpage/gaoptout. If you wish to disable Google Analytics tracking on your mobile devices, please click on the following link http://tools.google.com/dlpage/gaoptout to set the relevant opt-out cookie.

We use Google Analytics in order to analyse and regularly improve the use of our website. The statistics enable us to improve our offering and make it more interesting for you as a user.

For further information, please see the following links: Google Analytics terms of service: https://marketingplatform.google.com/about/analytics/terms/, overview of Google Analytics security and privacy principles: https://support.google.com/analytics/answer/6004245.

This website also uses Google Analytics for cross-device analysis of visitor traffic by means of a user ID. You can disable the cross-device analysis of your use in your customer account, under “My data”, “Personal information”.

The legal basis for the use of Google Analytics is your consent under Article 6(1)(a) GDPR and Article 5(3) of the e-Privacy Directive. You may withdraw your consent at any time with future effect, for example by changing your cookie settings.

Your data is processed only if you have given your consent, and for as long as this remains necessary for the intended purpose. Cookies and other trackers already set by Google are not affected. For this processing activity, Google is the competent controller.

2.2.2. Google Ads

We use the Google Ads offering in order to draw attention to our attractive offers by means of advertising (known as Google Ads) on external web pages. The data relating to the advertising campaigns enables us to determine how successful the individual advertising measures are. We want to show you advertising that interests you, to make our website more attractive for you and to achieve a fair calculation of advertising costs.

These marketing materials are delivered by Google via what are known as “ad servers”. To that end, we use ad server cookies, which make it possible to measure certain performance indicators such as ad impressions or user clicks. When you reach our website via a Google ad, Google Ads places a cookie on your device. These cookies generally expire after 30 days and are not intended to identify you personally. For these cookies, the analysis values usually stored are the unique cookie ID, the number of ad impressions per placement (frequency), the last impression (relevant for post-view conversions) and opt-out information (indicating that the user no longer wishes to be contacted).

These cookies enable Google to recognise your internet browser. If a user visits certain pages of an Ads customer's website and the cookie stored on their computer has not yet expired, Google and the customer will be able to see that the user clicked on the advertisement and was redirected to that page. The tracking tool can therefore be used to evaluate the behaviour of website visitors and analyse their interests (profiling). Accordingly, the user profiles created by Google are used for targeting purposes on Google's websites. Each Ads customer receives a different cookie. The cookies cannot therefore be tracked across the websites of Ads customers. We ourselves do not collect or process any personal data in connection with the advertising measures described above. We receive only statistical evaluations from Google. On the basis of these evaluations, we can identify which advertising measures are particularly effective. We do not receive any further data arising from the use of the advertising material; in particular, we cannot identify users on the basis of this information.

Because of the marketing tools used, your browser automatically establishes a direct connection with the Google server. We have no influence over the extent of the data collected by Google through the use of this tool, nor over the subsequent use of that data. We therefore inform you to the best of our knowledge: through the inclusion of Ads Conversion, Google receives the information that you have viewed the relevant part of our website or clicked on an advertisement we have published. If you are registered with a Google service, Google can associate the visit with your account. Even if you are not registered with Google or are not logged in, it is possible that the provider will discover and store your IP address.

The legal basis for the use of Google Ads is your consent under Article 6(1)(a) GDPR and Article 5(3) of the e-Privacy Directive. You may withdraw your consent at any time with future effect, for example by changing your cookie settings.

If you do not select Google Ads in your cookie settings, or if you withdraw your consent, Google will collect only non-personal data (Google Consent Mode). Further information is available at https://support.google.com/analytics/answer/9976101.

Your data is processed only if you have given your consent, and for as long as this remains necessary for the intended purpose. Cookies and other trackers already set by Google are not affected. For this processing activity, Google is the competent controller.

2.2.3. Google Remarketing

In addition to Google Ads, we use the Google Remarketing application, which enables us to show you our advertising during your subsequent use of the internet after you have visited our website. For this purpose, cookies are stored in your browser, allowing Google to record and evaluate your user behaviour when you visit various websites (profiling). This enables Google to determine that you have already viewed our website. According to Google, the data collected for remarketing is not combined with any personal data that Google may hold. Google states in particular that pseudonymisation is used for remarketing.

The use of remarketing makes it possible to collect information about your browsing behaviour in anonymised form for marketing purposes and to store it on your computer by means of cookies (targeting/retargeting). On the basis of an algorithm, we can then present you with targeted product recommendations in the form of personalised advertising banners on other websites (the “publishers”). If you wish to prevent this, you can disable this feature using the Ads Preferences Manager (https://www.support.google.com/ads/answers/2662922).

The legal basis for the processing of your data is your consent under Article 6(1)(a) GDPR and Article 5(3) of the e-Privacy Directive. You may withdraw your consent at any time with future effect, for example by changing your cookie settings.

If you do not select Google Remarketing in your cookie settings, or if you withdraw your consent, Google will collect only non-personal data (Google Consent Mode). Further information is available at https://support.google.com/analytics/answer/9976101.

Your data is processed only if you have given your consent, and for as long as this remains necessary for the intended purpose. Cookies and other trackers already set by Google are not affected. For this processing activity, Google is the competent controller.

2.2.4. Google reCAPTCHA

This website uses Google reCAPTCHA to check whether the data entered on our website (in a contact form, for example) was entered by a human being or by an automated program (a “bot”).

This analysis starts automatically as soon as the visitor accesses the website.

This service enables Google to determine from which website your request was sent and from which IP address the reCAPTCHA input field was used. In addition to your IP address, Google may collect other information necessary to provide and secure this service.

The legal basis for this processing is your consent under Article 6(1)(a) GDPR and Article 5(3) of the e-Privacy Directive.

2.2.5. Google Maps

This website uses Google Maps to display our location and provide directions (for example via our store locator and our event calendars). If you access Google Maps elements embedded in our website, Google will store a cookie on your device via your browser. All data and user settings are processed for the purpose of displaying a location and providing directions.

When you connect to Google in this way, Google can determine from which website your request was sent and to which IP address the directions are transmitted.

The legal basis for this processing is your consent under Article 6(1)(a) GDPR and Article 5(3) of the e-Privacy Directive. You may withdraw your consent at any time with future effect, for example by changing your cookie settings.

Your data is processed only if you have given your consent, and for as long as this remains necessary for the intended purpose. Cookies and other trackers already set by Google are not affected. For this processing activity, Google is the competent controller.

2.2.6. YouTube videos

We have also embedded YouTube videos in our websites. The videos are stored at www.youtube.com and can be played directly from our websites. These videos are embedded in such a way that no personal data associated with you as a user is sent to YouTube if you do not play the videos.

If you play the videos, YouTube cookies will be stored on your computer and data will be sent to the registered office of Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland, for users of Google services based in the European Economic Area or Switzerland. If you are in the United Kingdom or the United States, the data will be sent to Google, Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA, as the operator of YouTube. When you play videos on YouTube, the personal data sent to Google, Inc. is as follows: the IP address and the cookie ID, the precise address of the page visited on our websites, the browser language settings, the system date and time of access and your browser ID. The data is transmitted regardless of whether you are registered with Google or logged in. If you are logged in, this data will be attributed directly to your account (profiling).

If you do not wish this data to be attributed to your profile, you must log out before activating the button. YouTube or Google, Inc. stores this data as user profiles and uses it for advertising, market research and/or demand-driven design of its websites. This use serves in particular (and not only in the case of logged-in users) to deliver demand-driven advertising and to inform other users of your activities on our website. You have the right to object to the creation of these user profiles. To exercise this right, you must contact Google Inc. as the operator of YouTube. To find out more about the purpose and extent of the collection and processing of data by Google, Inc., see www.google.at/intl/policies/privacy/. We do not process the personal data collected when a YouTube video is played.

YouTube videos set cookies only after your consent has been obtained in accordance with Article 6(1)(a) GDPR and Article 5(3) of the e-Privacy Directive. You may withdraw your consent at any time with future effect, for example by changing your cookie settings. After you have withdrawn your consent, you will no longer be able to open the YouTube videos on our website. Cookies and other trackers already set by YouTube are not affected. For this processing activity, YouTube (Google) is the competent controller.

2.2.7. Google Ads Customer Match

In order to improve our relationship with you and your experience as a customer, we use the Google Ads Customer Match customer list targeting tool. To that end, we convert the email address you have provided to us into a hashed code, which we transmit to Google. Google will then match the code with your Google account (if you have one) and deliver our ads on its platforms while you are using them.

We process your data on the basis of your consent in accordance with Article 6(1)(a) GDPR. You may withdraw your consent at any time with future effect, for example by changing the settings in your customer preference centre.

Your data is processed only if you have given your consent, and for as long as this remains necessary for the intended purpose. If consent is withdrawn, or if the processing is no longer necessary for the intended purpose, the data will be deleted immediately.

2.3. Facebook Business Manager

Facebook Business Manager is a tool that helps us to create, manage and monitor various business-related assets on Facebook and Instagram in an organised and targeted way – such as our Facebook business pages, our Instagram profiles and our advertisements – and to report on those assets. Facebook Business Manager also includes a wide range of business tools, explained below:

Facebook's business tools are technologies offered by Facebook Inc. and Facebook Ireland Limited that help website owners and publishers, app developers and business partners, including advertisers and others, to integrate with Facebook, to understand and measure their products and services, and to better reach and serve the people who use, or might be interested in, their products and services.

All these tools can be used for what are known as the “Facebook products”, which include Facebook (including the Facebook mobile app and in-app browser), Messenger, Instagram (including apps such as Boomerang), Facebook Shops, Spark AR, Audience Network and any other feature, app, technology, software, product or service offered by Facebook Inc. or Facebook Ireland Limited under Facebook's data use policy. For further details, please also see sections 2.3.1 to 2.3.3 below.

All the services referred to in sections 2.3.1 to 2.3.3 are provided by Meta Platforms Inc., 1 Meta Way, Menlo Park, CA 94025, USA (hereinafter “Meta US”) and Meta Platforms Ireland Ltd, Merrion Road, Dublin 4, Ireland (hereinafter “Meta EU”).

We have concluded corresponding data processing agreements with Meta US and Meta EU.

2.3.1. Facebook Pixel and CAPI

For conversion measurement, our website uses Facebook's visitor action pixel and the Conversions Application Programming Interface (hereinafter “CAPI”).

Since we use the “Custom Audiences” remarketing feature, which you can disable at any time as described below, your behaviour can be tracked once you have been redirected to our website by clicking on a Facebook advertisement. The effectiveness of Facebook advertisements can therefore be evaluated for the purposes of statistical and market research and with a view to optimising future advertising measures.

The data collected is anonymous to us as the operators of this website; we cannot draw any conclusions as to the identity of users. However, the data is stored and processed by Facebook so as to enable a connection with the respective user profile and so that Facebook can use the data for its own advertising purposes in accordance with Facebook's data use policy (profiling). Facebook can thereby enable advertising to be displayed on Facebook sites and outside Facebook. As the site operator, we have no influence over this use of data.

See Facebook's data protection notice for more information on how to protect your privacy: https://www.facebook.com/about/privacy/.

You can also disable the “Custom Audiences” remarketing feature in the advertising settings at https://www.facebook.com/ads/preferences/. To do so, you must be logged in to Facebook.

If you do not have a Facebook account, you can opt out of Facebook commercial advertising on the European Interactive Digital Advertising Alliance website: http://www.youronlinechoices.com/uk/your-ad-choices.

The legal basis for the processing of your data is your consent under Article 6(1)(a) GDPR and Article 5(3) of the e-Privacy Directive. You may withdraw your consent at any time with future effect, for example by changing your cookie settings.

Your data is processed only if you have given your consent, and for as long as this remains necessary for the intended purpose. Cookies and other trackers already set by Meta are not affected. For this processing activity, Meta is the competent controller.

2.3.2. Facebook/Instagram Lead Ads

To enable you to subscribe to our newsletter and/or take part in a prize draw via Facebook/Instagram, we run advertisements on our Facebook and Instagram accounts (for example, Facebook: padelspirit_ch, Instagram: padelspirit_ch).

Please note that:

if you subscribe to our newsletter through advertisements, the information given in section 4.5 applies mutatis mutandis, subject to the following change: apart from your IP address, which we do not collect, we use the same personal data (that is to say your first name, email address, country and language), but we have included a mandatory field (“country”). Your language is localised automatically on the basis of the language you use for your social media page at the time you subscribe to the newsletter (instead of localising country and language via the Browser Region Manager);

if you subscribe to our newsletter as part of your participation in one of our prize draws through advertisements, the information given in section 4.6 applies subject to the following change: we do not collect your IP address.

On the basis of the consent you have freely given to receive the newsletter, and once you have validated your subscription by pressing the button contained in the confirmation email (double opt-in), your first name, email address, IP address and country will be processed by us for the purpose of sending (i) personalised marketing and product information about the products in our shop, (ii) personalised promotional information and news matching your interests and based on your use of the website (for example: frequently viewing products falling within your selected interests and your geolocation), (iii) satisfaction surveys concerning our shop's services and products, and demand analyses, (iv) competitions, coupons, promotional campaigns and prize draws, and (v) electronic greetings cards by email.

Subscription through the form will take effect only if you activate it by “clicking” on the confirmation link contained in the confirmation email you receive. When completing the subscription form, please note that the only mandatory personal data is the data held by Facebook/Instagram or that you provide on an optional basis (in all cases your email address and your name, and generally also your country). We use the personal data provided exclusively in order to send you our newsletter by email as described above, provided that you have expressly consented to this. You may withdraw your consent to receive the newsletter at any time, with future effect and without giving reasons. For further details on how we generally process your personal data when you subscribe to our newsletter, please see section 4.5.

The legal basis for the processing of your data is your consent to receive our newsletter or to take part in prize draws, under Article 6(1)(a) GDPR and Article 5(3) of the e-Privacy Directive. You may withdraw your consent at any time with future effect, for example by unsubscribing from the newsletter. You will find further information on the processing of data in connection with our newsletter, prize draws or similar activities in sections 4.5 and 4.6.

2.3.3 Custom Audiences created from a customer file

In order to improve our relationship with you and your experience as a customer, we use Meta's Custom Audiences created from a customer file. To that end, we convert the email address you have provided to us into a hashed code, which we transmit to Meta. Meta will then match the code with your Meta account (if you have one) and deliver our ads on its platforms while you are using them.

You will find further information on how Meta uses the data from Custom Audiences created from a customer file here.

2.4. TikTok Pixel

On our website we use the “TikTok Pixel” from the provider TikTok (for users in the EU, the EEA and Switzerland: TikTok Technology Limited, 10 Earlsfort Terrace, Dublin, D02 T380, Ireland; for the United Kingdom: TikTok Information Technologies UK Limited, 6th Floor, One London Wall, London, EC2Y 5EB, United Kingdom; for users in the United States: TikTok Inc., 5800 Bristol Parkway, Suite 100, Culver City, CA 90230; for TikTok Australia: TikTok Pte. Limited, One Raffles Quay, #26-10, South Tower, Singapore 048583). If you have given your explicit consent, which you may withdraw at any time with future effect (for example via your cookie settings), the TikTok Pixel enables TikTok to define you, as a user of our online offering, as a target group for the display of advertising (known as “TikTok Ads”) (profiling).

We use the TikTok Pixel to display the TikTok Ads we have placed only to “Custom Audiences”, that is to say to TikTok users who have also shown an interest in our online offerings or who display certain characteristics (for example, interests in particular topics or products) that we transmit to TikTok. With the help of the TikTok Pixel, we also want to ensure that our advertising on TikTok matches users' potential interests and is not intrusive. The data collected is anonymous and is not visible to us. We use it solely to evaluate the effectiveness of TikTok Ads for statistical and market research purposes, by observing user behaviour once users have been redirected to our website after clicking on a TikTok advertisement (known as a “conversion”).

For further information, please see the following links:

TikTok's privacy policy: www.tiktok.com/legal/new-privacy-policy

TikTok's general terms of service: www.tiktok.com/legal/new-terms-of-service

The legal basis for the processing of your data is your consent under Article 6(1)(a) GDPR and Article 5(3) of the e-Privacy Directive. You may withdraw your consent at any time with future effect, for example by changing your cookie settings.

Your data is processed only if you have given your consent, and for as long as this remains necessary for the intended purpose. Cookies and other trackers already set by TikTok are not affected. For this processing activity, TikTok is the competent controller.

2.5. Microsoft Advertising

On our website we use Microsoft Advertising from Microsoft Corporation (One Microsoft Way, Redmond, WA 98052-6399, USA; “Microsoft”).

The data processing serves marketing and advertising purposes, as well as measuring the effectiveness of advertising measures (conversion tracking). It enables us to find out the total number of users who clicked on one of our advertisements and were redirected to a website containing a conversion tracking tag. Personal identification of those users is not, however, possible. Microsoft Advertising employs technologies such as cookies and tracking pixels that make it possible to analyse your use of the website. When you click on an advertisement published by Microsoft Advertising, a cookie for conversion tracking will be stored on your computer. This cookie has a limited validity and is not used for personal identification. If you visit certain pages of our website while the cookie has not yet expired, Microsoft and we will be able to see that you clicked on the advertisement and were redirected to that page. The information that may be collected is as follows: IP address, identifiers (tags) assigned by Microsoft, details of your browser and your device, referrer URL (the website from which you reached our website), URL of our website.

We also use the “remarketing” feature, which enables Microsoft to track your consumer behaviour and thus to show you personalised advertising on Microsoft's websites or in its apps.

If you do not wish information about your consumer behaviour to be used by Microsoft in the manner described above, you can refuse the installation of the necessary cookies. The automatic installation of cookies can be disabled in your browser settings. In addition, you can prevent the collection and processing of the data generated by the cookie and of the data relating to your use of the website by objecting via the following link: https://account.microsoft.com/privacy/ad-settings/signedout

Further information on data protection and the cookies used by Microsoft is available on Microsoft's website at: https://www.microsoft.com/en-gb/privacy/privacystatement

The legal basis for the processing of the data is your consent under Article 6(1)(a) GDPR and Article 5(3) of the e-Privacy Directive. You may withdraw your consent at any time with future effect, for example by changing your cookie settings.

Your data is processed only if you have given your consent, and for as long as this remains necessary for the intended purpose. Cookies and other trackers already set by Microsoft are not affected. For this processing activity, Microsoft is the competent controller.

2.6. Ratings and reviews

Ratings and reviews help to improve the experience of the users of our online store through individual assessments of our products and services.

Anyone who has already had an experience with one of our products and wishes to share it may rate and comment on the product concerned on padelspirit.ch. To do so, simply go to our review form via our website and provide the relevant details. After submitting your review, you will receive a confirmation email asking you to confirm that you wrote the review submitted. Once you have confirmed, we will add a note indicating that the review was written by a verified reviewer. If you do not confirm your submission, no information will appear next to your name. Apart from that, confirming your review will not affect its display or its publication.

After making a purchase on our website, and provided you have not opted out of receiving commercial communications, you will receive various emails, including a request to rate and, where applicable, assess the product or products purchased as a verified buyer, a reminder offering you the opportunity to submit a rating if you have not yet done so, and a thank-you message in the event that you have submitted a rating.

Before you submit a product review, we ask for your consent to the processing of the personal data you have provided in your review, as described below, and to the use of the content you have provided in accordance with this privacy policy.

To submit a review, you must complete the mandatory fields indicated in the review form. In addition, you may, if you wish, provide further information about yourself, the product purchased or the content of the purchase or download. Which information is mandatory and which is optional depends on the product purchased, as clearly indicated in each review request, and may therefore vary. The information we may request is as follows: the title of your review, the text of the review, email address, name, age, gender, size, fit, sporting ability, sporting style, width, length, grip, recommendation, quality rating, comfort rating, appearance rating, flexibility rating, warmth rating, frequency of use, preferred use, preferred sport, preferred specifications, preferred features, preferred surface and any photographic content you choose to upload in connection with your comment.

After submitting your review, you will also have the option of sharing it with certain service providers (for example: Facebook, Twitter, Google, LinkedIn, Instagram). Following your submission, your review, the title of your review, your “verified buyer” status, the date of the review, your first name and the first letter of your surname (but not your name in full), any photo or video content provided by you and any other content provided by you in connection with the submission of your review may be published free of charge on our website (for example in our photo gallery or on our product pages), in our newsletter, on Google and/or on our social media channels in order to promote our products and services.

If you choose to share your review with another service provider, that data will also be transmitted to the service provider chosen. You will find further information on the purpose and extent of the data processing, as well as on your rights and the settings available for protecting your privacy, in the privacy policy of the service provider concerned, as indicated in section 3 of this privacy policy.

The legal basis for this processing is your consent under Article 6(1)(a) GDPR. You may withdraw your consent at any time with future effect, for example by sending an email to info@padelspirit.ch.

Your data is processed only if you have given your consent, and for as long as this remains necessary for the intended purpose. If consent is withdrawn, or if the processing is no longer necessary for the intended purpose, the data will be deleted immediately.

2.6.1. Display of social media content

When we see a post we like (usually because we and/or our products have been tagged or mentioned by you on your Instagram account), we contact you via Instagram and ask you to consent to the use of the personal data it contains (such as your photo or video, the text of your post, your Instagram username, the time of the post), in accordance with this privacy policy. Only if and after you consent to this use may your content be published free of charge on our website (for example in our photo gallery or on our product pages), on our social media channels and/or in our newsletters in order to promote our products and services. The content of the widget is then transmitted directly from Instagram to your browser via a connection to Instagram's servers and embedded in the website by your browser.

3. OPERATION AND USE OF SOCIAL MEDIA ACCOUNTS

We operate several accounts on social media platforms or networks, or use such social networks or platforms, in order to communicate with our customers, interested parties and other users and to inform them about our brands, products and services.

We would draw your attention to the fact that social media companies may process user data outside the European Union when you visit their websites, which may entail risks for users (it could, for example, be difficult for users to enforce their rights as data subjects).

Please note that when you visit the website of social media platforms, they generally process your data for market research and advertising purposes. For example, they may create user profiles on the basis of user behaviour and users' documented interests. These user profiles may then be used to place advertising, within and outside the platforms, intended to match users' interests. For these purposes, cookies are generally stored on the user's computer. In addition, the data may also be stored in the user profiles irrespective of the devices used by the users (in particular where the users are registered users of the platforms in question and are logged in).

The processing of your personal data when you visit our social media channels takes place on the basis of our legitimate interests (effective information and communication with customers, prospective customers and users) in accordance with Article 6(1)(f) GDPR, in order to learn more about our followers and to respond to the respective posts or other actions on our profile.

As regards the exercise of data subject rights under the GDPR, please note that the most effective method is to assert them with the social network providers. Only the social network providers have access to your personal data and can take appropriate action directly and provide you with information. If you nevertheless need assistance, please do let us know.

4. HANDLING OF PERSONAL DATA WHEN THE USER TAKES AN ACTIVE STEP

In addition to the purely informational use of our website, we offer you a number of services there which you can use if you are interested and which we describe in the following sections. In order to take advantage of them, you will generally need to provide further personal data, which we will use to provide you with the service concerned. You will receive further information on this at the time you provide your personal data or in the description of the service below.

4.1. Getting in touch

When a user actively contacts us by email or via our contact form (for example, with enquiries about product safety or in connection with a promotion), the user's data and information is stored for the purpose of handling the enquiry and in case of follow-up questions, and passed on to the person responsible (the IT department, the legal department, logistics, and so on). Once your issue has been resolved, if we receive no reply from you and we are under no legal obligation requiring longer storage, we will delete your data within 6 months at the latest.

We process your personal data under Article 6(1)(b) GDPR where necessary for the performance of the contract or in order to take steps at your request before entering into a contract, under Article 6(1)(c) GDPR in order to comply with legal obligations, and on the basis of our legitimate interest under Article 6(1)(f) GDPR in responding appropriately to individual requests from customers and visitors. We do not wish to receive or process sensitive data within the meaning of Article 9 GDPR, such as data concerning your health or data relating to your medical information.

4.2. Purchases in the online store

If you make a purchase through this website, we collect, store and process personal data (your name, billing and delivery address, email address, telephone number and the serial number assigned to the items ordered, together with information about the products you have purchased) for the purposes of performing the contract and any post-contractual obligations (such as a warranty), or even for manufacturing purposes in the case of orders personalised by Padelspirit. To that end, we pass on your name, telephone number and delivery address to transport or courier services for the delivery of the products you have purchased, and we also pass on payment and transaction data to credit or financial institutions for the processing of the payment. Concluding and performing the contract requires personal data to be provided.

We may also process the data you have provided in order to ask you to review a product you have purchased, to inform you about offers, news, surveys and competitions relating to similar Padelspirit products or services, or to send you emails connected with your orders or containing technical information, in accordance with Article 13 of the e-Privacy Directive. You may object to the use of your data at any time and free of charge where the processing is carried out for direct marketing purposes (for further details, please see section 9).

We process your personal data in the context of performing the contract under Article 6(1)(b) GDPR and on the basis of our legitimate interest, under Article 6(1)(f) GDPR, in providing our customers with a simple and modern shopping experience.

We will retain your data for the period prescribed by the applicable legal framework, such as national tax legislation.

4.3. Processing of personal data on the basis of our legitimate interests

We may also process the personal data provided in connection with your use of our shop, your registration or the placing of your order (your name, billing and delivery address, email address, telephone number, the serial number assigned to the item ordered, together with the additional information about the products you have purchased) in order to improve our products and services. In addition, on the basis of our legitimate interests, we process the categories of data referred to for statistical and internal operational purposes, for example in order to measure and understand trends relating to demographics, users, user interests, purchases and other trends among our users, as well as for recall campaigns and for the prompt handling of complaints. The categories of data referred to are also processed for research purposes, for precautionary and defensive measures and for other measures concerning, in particular, failure to comply with this privacy policy, unlawful acts or suspected fraud, or in order to take action in situations where there is a risk of infringement of our rights or the rights of others. You may object to the use of your data at any time where the processing is carried out for direct marketing purposes (for further details, please see sections 4.5 and 9).

4.4. Creating a Padelspirit account

You have the option of joining Padelspirit as a member and creating your personalised member account on our website.

If you register, we collect, store and process your personal data for the purpose of handling your orders and providing you with the benefits, promotions and offers you have obtained by purchasing our products on the website.

In order to create your Padelspirit member account, you will be asked to provide the following data: first name, surname, date of birth (optional), confirmation that you are of legal age or confirmation of your legal guardian's consent to your registration with Padelspirit, email address and password. In addition, we process the date on which you registered with or unsubscribed from Padelspirit, the current accumulated value, the products purchased as a member and their total value, the benefits received, the returns and refunds relating to products purchased as a Padelspirit member, and account activity relating to compliance with the respective rules on use and purchases.

This means, on the one hand, that your personal data is saved and that you do not have to enter it every time you place a new order with us and, on the other hand, that you can easily manage your contact details and your previous orders. In your Padelspirit member account you will find a complete overview of your contact details, orders not yet delivered, past orders and delivery, payment and returns details.

If you create a member account on our website, we will be able, from the moment your member account is created, to associate with it the previous interactions you have had on our website (your click path, the forms completed, the purchases made, the reviews given, the benefits unlocked, and so on). If you make a purchase while logged in to your Padelspirit member account, the data relating to the purchase and, for as long as you remain logged in, the interaction data relating to your browsing behaviour on our website will be attributed to your profile. The data is stored on Shopify and processed for the purposes of making purchases, improving our offering and our services, and personalised advertising.

We process your personal data on the basis of the necessity of performing the contract (Article 6(1)(b) GDPR) and on the basis of our overriding legitimate interest (Article 6(1)(f) GDPR) in offering you a multifunctional user account and an attractive, modern loyalty programme. For users in California (USA), the processing is based on their consent under Title 11, sections 7070 to 7071 of the California Code of Regulations.

We will retain your data until you decide to unsubscribe from Padelspirit.

As a member, you will regularly be offered various financial incentives. These may include gifts, prize draws, early, exclusive or extended access to sales and discounts, and early or exclusive access to new products or collaborations.

4.5. Newsletter

Below you will find a description of how we generally process your personal data when you subscribe to our newsletter on padelspirit.ch. Please note that this process may not apply in full in every case (the personal data we collect may differ, for instance). In the event of discrepancies, you will find all the specific information in the corresponding section of our privacy policy (for example in section 2.3.2 if you subscribed via Facebook/Instagram advertisements, or in section 4.2 if you made a purchase on padelspirit.ch).

Please note that all newsletter subscribers must be at least 16 years old. On the basis of the consent you have freely given under Article 6(1)(a) GDPR and Article 13(1) of the e-Privacy Directive to receive the newsletter, and once you have validated your subscription by pressing the button contained in the confirmation email (double opt-in), your first name, email address, IP address, country and language (as explained in more detail below) and, on an optional basis, the areas of particular interest to you (or any other additional information you provide of your own accord if you update your newsletter profile) will be processed by us for the purpose of sending (i) personalised marketing and product information relating to the goods and services in the sports range of our various brands, (ii) personalised promotional information and news matching your interests and/or based on your use of the website (for example: frequently viewing products falling within your selected interests and your geolocation), (iii) satisfaction surveys concerning Padelspirit's services, products and advice, and demand analyses, (iv) competitions, coupons, promotional campaigns and prize draws, and (v) electronic greetings cards by email.

Where we collect your email address in connection with the sale of a product or service, we may also use your email address for the direct marketing of similar products or services (via our newsletter), provided that you did not initially refuse to receive such communications. You have the right to unsubscribe at any time, and we will provide you with an opportunity to unsubscribe in all such communications, for example via an unsubscribe link. The legal basis for this processing is our legitimate interest under Article 6(1)(f) GDPR and Article 13(2) of the e-Privacy Directive. (does not apply to customers resident in Australia)

Using your IP address and with the help of our “Browser Region Manager”, we can locate the region you are in when you use the site. This information will be saved in order to direct you to the regional sub-page and the newsletter subscription applicable to your country of residence. In doing so, we do not determine your exact location. You can change the country assigned to you manually, either before subscribing to our newsletter, using the drop-down country menu on our site, or after subscribing to the newsletter by updating your preferences (instead of localising country and language via the Browser Region Manager).

You can update your profile and your newsletter preferences at any time (for example, via a link at the end of each newsletter). Possible fields include: name, gender, date of birth, address, further details about your interests, your preferences and your sporting abilities. After you update your preferences, we will use the updated data instead of the previous data as described in this privacy policy. This means that if you change the country setting, for example from Germany to France, you will receive the French newsletter instead of the German version.

Personalised advertising material and news are sent on the basis of your IP address and your user behaviour on the site (profiling). Using your IP address and with the help of our “Browser Region Managers”, we can send you regional offers, in so far as you have consented to this. In doing so, we also analyse click frequency solely for the interests you have selected (“rackets, sportswear, balls, padel”), and where you make frequent use of the “balls” section, for example, we send you information on that area of interest by email, on the basis of the declaration of consent described above. The analysis is carried out on the basis of the following evaluation methods and order of preference: the data concerning your behaviour on the site is compared anonymously with empirical values from similar data sets in our database. On the basis of this comparison, we calculate the probability of contacts and possible future purchases with us. This enables us to make suitable offers and to send information which, in our experience, has been of interest to customers displaying similar behaviour. This process also enables us to create anonymised and pseudonymised user profiles.

We also store your IP address and the date and time of your newsletter subscription. These are retained solely to serve as evidence in the event of the misuse of an email address by a third party subscribing to the newsletter without the knowledge of the genuine owner. The personal data collected at the time of newsletter subscription is not passed on to third parties for marketing purposes.

You may withdraw your consent to receive the newsletters at any time, with future effect and without giving reasons (for example via an unsubscribe link at the end of each newsletter or by email to info@padelspirit.ch).

4.6. Prize draws

In connection with the prize draws or promotional activities we offer, we will use your personal data solely for the purpose of running the prize draw or promotional activity (to contact the winners or send the prize, for example), unless you have given explicit consent under Article 6(1)(a) GDPR for other uses (receiving our newsletter, publishing your review, and so on). You will receive the specific information concerning the processing of your personal data in the terms and conditions of the prize draw in question.

Please note that if you subscribe to our newsletter as part of your participation in one of our prize draws, the information given in section 4.5 applies mutatis mutandis, subject to the following changes:

we collect your surname and your country (in addition to your first name, email address and IP address), and

you must confirm that you are at least 18 years old (instead of 16).

If you subscribed through advertisements on Facebook/Instagram, please also see section 2.3.2.

5. Disclosure of your personal data to third parties

We also disclose your personal data, to the extent necessary, to agents responsible for performance or to external service providers:

to IT service providers and/or providers of data hosting, data processing or similar services;

to other service providers and suppliers of tools and software solutions who also help us, on our behalf, to provide our services and to work (including suppliers of marketing tools, marketing agencies, communication service providers and call centres);

to other companies that supply padel equipment and that are responsible for the import and/or dispatch of the products;

to third parties involved in the performance of our obligations towards you (such as parcel delivery services for the delivery of the order you placed in our online store, payment service providers for processing payment in the online store, banks for processing payment);

to other external third parties to the extent necessary (auditors, insurance companies in the event of an insured event, legal representatives where applicable, and so on);

to public officials and authorities to the extent required by law (tax authorities, and so on).

6. Disclosure of your personal data to third parties outside the EU/EEA

We may disclose your personal data to companies and contractual partners outside the EU/EEA in order to provide our services, operate the website, process your order, maintain our IT systems and software, and so on. However, this disclosure does not alter our obligation to protect your personal data in accordance with this privacy policy. If your personal data is transferred outside the EU/EEA, we guarantee that an adequate safeguard will be put in place, either by transferring it to countries with an appropriate level of protection confirmed by the European Commission, or by concluding an appropriately worded contract between ourselves and the legal entity outside the EU/EEA receiving the data. In other cases, the transfer of data is based on Article 49(1) GDPR. You can obtain a copy of the appropriate safeguards by sending us an email at info@padelspirit.ch.

7. Data security

We take appropriate technical and organisational security measures to protect your personal data against accidental or unauthorised deletion or alteration, against loss and theft, and against unauthorised consultation, transfer, reproduction, use, alteration or access. We and our employees are also bound by professional secrecy and by a duty of data confidentiality. Likewise, agents responsible for performance and authorised representatives of Padelspirit who need access to your personal data in order to fulfil their professional obligations will have such access and will be subject to the same obligations of professional secrecy and data confidentiality.

8. Retention period

As a general rule, we store your personal data only for as long as is necessary to achieve the purposes described above. We retain the personal data processed through our website for as long as it is necessary for the performance of our contractual obligations as set out in the corresponding sections above. If the processing depends on your consent, we will retain that data for as long as you have not withdrawn your consent. We will also retain your data in accordance with the legal requirements of the Federal Act on Data Protection (FADP) and the General Data Protection Regulation (GDPR).

9. Your rights

You have the right to receive clear, transparent and intelligible information about how we process personal data and about your rights as a data subject (Article 13 et seq. GDPR).

You therefore have the right to be informed and to receive a copy of the personal data concerning you that is being processed (Article 15 GDPR).

If the personal data is incorrect or is no longer up to date, you have the right to have it rectified (Article 16 GDPR).

You also have the right to erasure of your data (the “right to be forgotten”) (Article 17 GDPR).

You also have the right to unsubscribe from marketing campaigns and to exercise your right to object in that regard at any time (Article 21(2) GDPR).

You may also withdraw your consent to the processing of personal data at any time and with future effect, where the processing is carried out on the basis of your consent (Article 7 GDPR).

You also have the right to data portability (Article 20 GDPR) in a commonly used, machine-readable format. This applies exclusively to data provided by you whose processing is based on a contract or on consent and is carried out by automated means.

Lastly, you have the right to request that the processing of data carried out by us be restricted (Article 18 GDPR). In that case, we will only be entitled to store the data and will no longer be able to use or process it. However, this applies only in the following situations:

you contest the accuracy of the personal data, for a period enabling us to verify its accuracy;

the processing is unlawful and you oppose the erasure of the data and request instead that its use be restricted;

we no longer need the personal data for the purposes of the processing, but you need it for the establishment, exercise or defence of legal claims;

you have objected to processing based on our legitimate interests and verification as to whether our legitimate grounds override yours is still pending.

You have the right not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects concerning you or similarly significantly affects you (Article 22 GDPR).

You also have the right to lodge a complaint with the competent data protection authorities if you consider that the processing of personal data concerning you infringes the applicable data protection legislation (Article 77 GDPR).

Before lodging a complaint with the data protection authorities, or if you have any questions, you may also contact us, for example using the contact details below:

Padelspirit, Rouge Gillian

For the attention of the legal department

Chemin de l'Ouche-Dessus 16, 1616 Attalens, Switzerland

Your right to object

As a data subject, you may object to the use of your data at any time where the processing is carried out for direct marketing purposes. If we process your data for legitimate purposes, you also have the right to object at any time where you have grounds for doing so relating to your particular situation. In that case, we ask you to state the reasons why the data should not be processed in future.

So that we can deal with your request concerning the rights set out above, and in order to ensure that personal data is not disclosed to unauthorised third parties, please send us your request together with a brief description of the scope of the rights referred to above that you wish to assert as a data subject.
